Possession of Crystal Meth Lawyer in Roxbury NJ

Pursuant to N.J.S.A. 2C:35-10(a), a Defendant caught possessing less than a 1/2 ounce of methamphetamine in New Jersey with be charged with a third degree felony. A third degree felony is punishable by up to five (5) years in a New Jersey State Prison, a fine up to $35,000 and a two year loss of driving privileges. In addition, a Defendant may also be forced to participate in a drug rehabilitation program as well.

Possession of Meth with the Intent to Distribute Attorneys in Mount Olive NJ

If a Defendant is caught possessing less than 1/2 ounce of methamphetamine but is charged with possession with the intent to distribute they will be facing a third degree felony as well. They would be facing the same penalties if charged withe simple possession. However, incarceration would be much more likely to be imposed. In addition, pursuant to Brimage, a Defendant would most likely be required to serve a custodial term with a parole ineligibility period as well.

If a Defendant is caught possessing more then 1/2 ounce but less than 5 ounce of methamphetamine they will be charged with possession with the intent to distribute in the second degree. A second degree felony is punishable by up to ten years in a State Prison, a fine up to $150,000 and a two year loss of driving privileges. In addition, Brimage would almost certainly apply as well.

If a Defendant is caught possessing more then 5 ounce of methamphetamine, they will be charged with possession with the intent to distribute in the first degree. A first degree felony is punishable by up to twenty years in a State Prison, a fine up to $200,000 and a two year loss of driving privileges. In addition, Brimage would almost certainly apply as well.
