However, the jurisdiction of the latter system in limited to hearing simple possession of marijuana and drug paraphernalia cases. The highest indictable felony grade of offenses is a first degree crime with charges descending downward to second, third and fourth degree crimes. Misdemeanor CDS charges fall within the grade of disorderly persons offenses. Where a charge falls within these classes hinges on the type of drug, the quantity and nature of the possession (e.g. personal use, distribution, etc.), and the location of the activity. The distinction between a first degree felony conviction and a disorderly persons offense conviction is staggering. If convicted of a first degree felony in New Jersey, a Defendant faces up to twenty (20) years in a New Jersey State Prison and fined up to $200,000. Conversely, if convicted of a disorderly persons offense in New Jersey, a Defendant faces up to six (6) months in the Morris County Jail and fine up to $1,000.
