Former Deputy Chief of the Parsippany Police Department Charged with DWI
It is unclear at this point in time what lead Parsippany Police Officers to the Elks Lodge parking lot but at approximately 4am on Wednesday morning they arrived and noticed an individual sleeping in his vehicle. According to the reports released thus far, they found the Defendant, a seventy-two year old male from Sparta New Jersey, apparently sleeping with his head tilted back. The officers assert that it took several attempts to actually wake the Defendant up. The reports released thus far do not indicate that the Defendant was put through the standardized field sobriety tests (SFST) but he was placed under arrest and taken down to the Parsippany police station to submit a breath sample. Back at the station the Defendant refused to submit a breath sample. As a result, the Defendant was charged with driving while intoxicated and refusal to submit to a breath test. He was released on a summons to appear in the Parsippany Municipal Court to answer the charges.
The Defendant was most likely placed under arrest due in large part to the fact that the officers noticed the vehicle was running. This is where an experienced Parsippany DWI defense lawyer can attack the operation aspect of the case. Was the Defendant attempting to operate the vehicle as required for a dwi conviction or was he simply “sleeping it off”?
