It has been reported that a local Montville police officer was arrested and charged with driving while intoxicated late Friday evening. Very little information has been released at this point in time but it is clear that the officer was in fact on duty at the time of his arrest. The officer has been formally charged with driving while intoxicated as well as careless driving. It does not appear that the officer was involved in any type of motor vehicle accident. According to the Montville Police Chief, the Defendant has been suspended without pay.
Since the officer has been charged with driving while intoxicated in the Township where he is employed, the case will most likely have to be transferred out to another township for prosecution. Although the DWI is traffic in nature, the Defendant may also be charged with official misconduct, which is a second degree felony. If the Defendant is in fact charged with official misconduct, the stakes would increase drastically. If convicted of official misconduct the Defendant would not only be terminated from his employment and lose his pension but he would also be looking at a mandatory State Prison sentence.
