A thirty-six (36) year old male from Morristown, New Jersey was arrested this week after he allegedly was involved in two separate motor vehicle accidents. Based on the reports released at this point in time, the Defendant was first involved in a motor vehicle accident in Parsippany, however by the time the police arrived, he had already fled the scene. While the officers were treating the occupants of the other vehicle they became aware of another motor vehicle accident in Morris Township involving the same type of vehicle. An investigation ensued and they were quickly able to determine that the Defendant was in fact the same person responsible for the first accident.
It was also determined that the Defendant was under the influence as well. He was arrested and charged with three separate counts of assault by auto, leaving the scene of an accident, reckless driving and driving while intoxicated. Two of the victims from the first crash were taken to Morristown Hospital to be further treated. Assault by auto can be either a disorderly persons offense (misdemeanor) or a second, third or fourth degree felony. The injury suffered by the victim and where the incident occurred will help dictate what degree of assault by auto a Defendant is charged with. Based on the initial reports here it appears that the Defendant will at least be charged with assault by auto in the fourth degree. Therefore, all of his charges will be sent to the Morris County Prosecutor’s Office for review. Although the Defendant was released on his own recognize and not held on bail he will need to appear at the Morris County Superior Courthouse which is located in Morristown, New Jersey for his Central Judicial Processing Hearing. If convicted of a fourth degree assault by auto in New Jersey a Defendant will be facing up to eighteen (18) months in a State Prison and a fine up too $10,000.
