Parsippany Resident Arrested for Heroin Possession

Ricky Moncion, 33, of Parsippany was arrested recently when Paterson police observed him getting out of his vehicle and into another vehicle. After searching Moncion’s vehicle after making this observation, police allegedly discovered about $3,000 worth of heroin packaged in 750 separate bags, and over $16,000 in cash.

Moncion is likely facing steep penalties in the wake of his arrest. New Jersey law, under N.J.S.A. 2C:35-10, prohibits possessing a wide array of different controlled substances, including heroin. Classified as a third-degree crime, possession of even small amounts of heroin carries harsh penalties such as jail time of up to 5 years, fines of up to $35,000, and a 6 month driver’s license suspension. In Moncion’s case, penalties will be exponentially more harsh since the amount of alleged heroin found in his possession is likely to exceed the one half ounce threshold that applies under the law in order to increase penalties. Additionally, since the heroin was separately packaged in smaller amounts and allegedly appeared to be ready for distribution, and possibly based on the quantity of heroin along if over one half ounce, Moncion is also likely to be up against charges for intent to distribute heroin. Assuming the amount of alleged heroin discovered in his possession exceeds one half ounce, the crime will escalate to a second-degree offense, and the potential penalties Moncion is facing will then increase to up to 5-10 years of potential jail time. If five ounces or more is at issue, the offense would become a first-degree crime, carrying potential penalties of 10-20 years in jail and fines of up to $500,000.
