Robbery Lawyers in Pequannock NJ
Robbery is one of the most serious offenses under the New Jersey criminal code. Pursuant to N.J.S.A. 2C:15-2, robbery is either a first or second degree felony. Meaning, at a minimum, if convicted of robbery in Morris County or elsewhere in New Jersey, a Defendant must serve at least five (5) years in a State Prison, but could serve up to twenty (20). In addition, robbery falls under the No Early Release Act (NERA), which in essence requires a Defendant to serve at least 85% of their sentence before the can become eligible for parole in New Jersey. Just to try to understand how severe NERA is, a Defendant convicted of a “non-nera” offense would most likely be eligible for parole in New Jersey after serving 1/3 of their original sentence.
