Underage Possession of Alcohol: N.J.S.A. 2C:33-15

The governing statute in New Jersey for underage possession of alcohol is N.J.S.A. 2C:33-15(a). Pursuant to the code, it is unlawful for anyone to purchase and/or possess and/or consume alcohol while under the age of twenty-one (21). This offense is considered a disorderly persons offense, also known as a misdemeanor. If convicted, a Defendant could face up to six (6) months in the Morris County Jail, a fine up too $1,000 and possibly court mandated inpatient or outpatient treatment for up to six (6) months.  In addition, if the violation occurred  in a motor vehicle, the Defendant would be required to serve a six (6) month license suspension as well.
